Terms of Service
Last updated: September 14, 2026
Overview
This website is operated by Ant's Sketchbook. Throughout the website and these Terms of Service, the terms "we," "us," and "our" refer to Ant's Sketchbook.
Ant's Sketchbook provides this website and related information, content, artwork, portfolio materials, products, features, tools, and services (collectively, the "Services") to you conditioned upon your acceptance of these Terms of Service and the policies incorporated into them.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and Services.
By visiting the website, creating an account, purchasing a product, accessing restricted content, submitting a professional inquiry, or otherwise using the Services, you agree to these Terms of Service.
If you do not agree to these Terms, you should not use the Services.
Eligibility and Lawful Use
By using the Services, you represent that you have the legal capacity to enter into these Terms or are using the Services with any authorization required under applicable law.
You may not use the Services or products for unlawful purposes or use the Services in a manner that violates applicable laws, regulations, or the rights of Ant's Sketchbook or any third party.
You may not knowingly introduce malicious code, interfere with the operation or security of the Services, attempt unauthorized access, or use the Services to facilitate fraud, abuse, infringement, or other unlawful conduct.
Products and Artwork
Ant's Sketchbook may offer physical artwork, prints, reproductions, digital artwork, digital files, merchandise, original or one-of-one works, limited works, commissioned works, and other products or Services.
We make reasonable efforts to display products accurately. However, colors and other visual characteristics may appear differently depending on displays, devices, lighting, photography, or other factors.
Product descriptions, availability, prices, dimensions, formats, and other information may be changed or corrected where appropriate.
Unless otherwise stated, displaying artwork through the Services does not constitute an offer to sell the original work displayed.
Orders
Submission of an order does not necessarily constitute final acceptance of that order.
We reserve the right, where permitted by law, to refuse, limit, cancel, or review an order for legitimate reasons, including:
- suspected fraud or unauthorized payment;
- inaccurate billing or shipping information;
- product unavailability;
- pricing or listing errors;
- quantity limitations;
- suspected resale or misuse;
- previous fraudulent or abusive activity; or
- circumstances preventing lawful or reasonable fulfillment.
If we cancel a paid order before fulfillment, amounts paid for the cancelled portion will ordinarily be refunded to the applicable payment method.
Prices and Payment
Prices displayed through the Services are subject to change before an order is placed.
You agree to provide current, complete, and accurate purchase and account information and to promptly update information where necessary.
By submitting a payment method, you represent that you are authorized to use that payment method and authorize the applicable charges associated with your order.
Applicable taxes, shipping costs, duties, and other charges may be added as disclosed during checkout or as otherwise required.
Physical Products
Physical products are subject to the applicable product description, Shipping Policy, and Returns & Refunds Policy.
Ownership of a physical copy of artwork does not transfer copyright or other intellectual property rights in the underlying artwork unless a separate written agreement expressly states otherwise.
Purchasing an original drawing, painting, print, or other physical work therefore does not, by itself, authorize the purchaser to reproduce, distribute, commercially exploit, license, digitize, merchandise, or create derivative works from the artwork.
Digital Products
Digital products may be delivered through downloads, links, accounts, email, third-party delivery systems, or other electronic means.
Digital purchases are subject to any license terms provided with the product and to these Terms.
Unless expressly stated otherwise, purchasing digital artwork constitutes the purchase of a limited license to use the delivered digital product, not a transfer of copyright or ownership of the underlying intellectual property.
Digital products are generally non-returnable after delivery, access, or download as described in our Returns & Refunds Policy, except where otherwise required by applicable law.
Intellectual Property
Unless expressly stated otherwise, all artwork, illustrations, designs, graphics, characters, compositions, photographs of artwork, portfolio pieces, digital files, logos, branding, website content, and other original creative materials displayed or provided through the Services remain the intellectual property of Ant's Sketchbook, the individual artist, or the applicable rights holder.
No sale, download, portfolio access, website visit, or other interaction with the Services transfers copyright, trademark rights, or other intellectual property rights except as expressly provided in writing.
All rights not expressly granted are reserved.
Permitted Use of Purchased Artwork
Unless a product listing or separate written license expressly provides otherwise, artwork purchased through the Services is intended for the purchaser's personal, non-commercial use.
A purchaser may possess and display a lawfully purchased physical work for personal purposes and may use a digital work within the scope of the license associated with that purchase.
No implied commercial license is created merely because payment was made for an artwork or digital file.
Prohibited Use of Artwork
Except where expressly authorized in writing or permitted by applicable law, you may not:
- reproduce or copy artwork for distribution;
- sell or redistribute digital files;
- manufacture products using the artwork;
- use artwork in commercial advertising or branding;
- sublicense artwork;
- publish or distribute high-resolution source files;
- falsely claim authorship or ownership;
- remove or falsify copyright, attribution, or rights-management information;
- create unauthorized commercial derivative works; or
- otherwise commercially exploit artwork belonging to Ant's Sketchbook or another applicable rights holder.
Nothing in these Terms is intended to prohibit uses independently permitted by applicable law.
Artificial Intelligence, Machine Learning, and Automated Dataset Use
Except with prior written authorization from the applicable rights holder or where such restriction is prohibited by applicable law, artwork, portfolio materials, digital products, and other protected creative content made available through the Services may not be systematically collected, scraped, downloaded, copied, or assembled for the purpose of:
- training or fine-tuning artificial intelligence or machine-learning models;
- creating training, evaluation, benchmarking, or similar datasets;
- generating unauthorized imitations or derivative commercial content;
- extracting stylistic or creative data through automated means for commercial model development; or
- supplying protected materials to third-party model-training or dataset services.
Access to the Services does not constitute consent or a license for such uses.
Portfolio Access
Certain portfolio materials may be restricted to users individually approved by Ant's Sketchbook.
An account, invitation, authorization, or other access mechanism grants only permission to view the authorized materials unless additional rights are expressly granted in writing.
Portfolio access does not grant permission to download, reproduce, distribute, publish, screen-capture for redistribution, commercially exploit, or provide restricted materials to unauthorized third parties.
Ant's Sketchbook may grant, deny, suspend, or revoke restricted portfolio access at its discretion, subject to applicable law and any separate agreement.
Account Security and Restricted Access
You are responsible for maintaining the confidentiality of your account credentials.
You may not knowingly:
- provide restricted portfolio access to an unauthorized person;
- allow another person to impersonate you to obtain restricted access;
- attempt to circumvent access controls;
- access restricted areas without authorization; or
- use credentials belonging to another person without authorization.
If you believe your account has been compromised, you should promptly secure the account and contact us where appropriate.
Professional Inquiries
The Services may allow prospective clients, employers, businesses, collaborators, or other parties to review portfolio materials or contact Ant's Sketchbook concerning professional opportunities.
Access to the portfolio or submission of an inquiry does not itself create:
- an employment relationship;
- an independent-contractor relationship;
- an agency relationship;
- an exclusivity arrangement;
- a partnership;
- a joint venture; or
- an obligation for either party to enter into a professional engagement.
Any professional engagement may be subject to a separate written agreement.
Commissions and Custom Work
Where Ant's Sketchbook accepts commissions, custom artwork, contract work, or other individually negotiated creative services, additional terms may apply concerning matters such as:
- scope;
- specifications;
- price;
- deposits;
- milestones;
- revisions;
- deadlines;
- cancellation;
- delivery;
- intellectual property ownership;
- licensing; and
- commercial-use rights.
Where a separate written agreement governs commissioned or professional work, that agreement will control over these Terms to the extent of any direct conflict concerning that engagement.
Returns, Refunds, and Cancellations
Returns, refunds, exchanges, and ordinary order cancellations are governed by our Returns & Refunds Policy, which is incorporated into these Terms.
Different rules may apply to physical products, digital products, original artwork, limited works, custom products, and commissioned work.
Nothing in these Terms eliminates rights that cannot lawfully be waived.
Shipping and Delivery
Physical fulfillment is governed by our Shipping Policy, which is incorporated into these Terms.
Customers are responsible for supplying accurate and complete shipping information.
Tracking, carrier scans, delivery confirmations, signatures where applicable, and other fulfillment records may be used to establish shipment and delivery history.
Digital products are electronically fulfilled and are subject to the applicable digital-delivery provisions rather than physical shipping requirements.
Fraud and Abuse
You may not use the Services to engage in fraud, attempted fraud, unauthorized transactions, deceptive conduct, deliberate misuse of refund procedures, or other abusive activity.
Where permitted by law, Ant's Sketchbook may investigate suspected abuse and may refuse or cancel transactions, restrict account access, revoke restricted portfolio access, decline future transactions, or take other reasonable protective action where credible evidence indicates fraudulent, malicious, or abusive conduct.
Chargebacks and Payment Disputes
If you experience a legitimate problem with an order, you are encouraged to contact Ant's Sketchbook so that the issue can be reviewed and, where appropriate, resolved.
Nothing in these Terms prevents you from exercising lawful rights available through your financial institution, payment provider, or applicable consumer-protection law.
Ant's Sketchbook nevertheless reserves the right to contest a chargeback or payment dispute that we reasonably believe is erroneous, materially inaccurate, fraudulent, abusive, or inconsistent with the documented transaction.
In responding to a dispute, relevant evidence may be supplied to Shopify, payment processors, card networks, financial institutions, fraud-prevention providers, dispute administrators, or other appropriate parties.
Such evidence may include, where relevant:
- order and transaction records;
- payment authorization information;
- applicable product descriptions;
- terms and policies in effect when the transaction occurred;
- shipping and tracking records;
- delivery confirmation;
- signature records;
- digital fulfillment, download, or access records;
- account activity;
- customer communications;
- refund or cancellation history; and
- other information reasonably relevant to the transaction or dispute.
Personal information used for these purposes will be handled in accordance with our Privacy Policy and applicable law.
No Right to Retain Refunded Digital Products or Licenses
Where a refund is issued for a digital product and applicable law permits, the license associated with the refunded purchase may terminate.
Following such termination, the customer must cease any use for which the purchase license was required and may not rely on the refunded transaction as authorization for continued reproduction, distribution, commercial use, or other licensed activity.
This provision does not restrict rights independently available under applicable law.
User Communications and Submissions
If you send inquiries, feedback, suggestions, reviews, or other communications through the Services, you represent that you have the right to submit that material and that it does not unlawfully infringe another person's rights.
Submitting a professional inquiry or private communication does not grant Ant's Sketchbook ownership of unrelated intellectual property contained in that communication.
If the Services later offer public reviews or other public submissions, additional terms may apply to those features.
Third-Party Services and Links
The Services may rely upon or link to third-party websites, payment providers, shipping carriers, social platforms, applications, or other services.
Ant's Sketchbook does not control unaffiliated third-party services and is not responsible for their independent content, availability, privacy practices, security practices, or contractual terms.
Your use of third-party services may be subject to separate agreements between you and those providers.
Shopify
The store uses Shopify's ecommerce infrastructure.
Certain aspects of transactions, accounts, payments, privacy controls, fraud analysis, and other functionality may therefore involve Shopify or providers integrated with Shopify.
Your interactions with services independently provided by Shopify may also be subject to Shopify's applicable terms and policies.
Privacy
Personal information collected or processed through the Services is governed by our Privacy Policy, which is incorporated into these Terms.
That Policy describes, among other things, information processing associated with purchases, accounts, restricted portfolio access, security, fraud prevention, fulfillment, chargebacks, and legal disputes.
Errors, Inaccuracies, and Omissions
Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, availability, or other matters.
Where permitted by applicable law, Ant's Sketchbook may correct errors, update information, or cancel an affected order when reasonably necessary.
If a paid order is cancelled because of such an error, the applicable payment will ordinarily be refunded.
Availability and Modification of the Services
Ant's Sketchbook may modify, suspend, discontinue, add, or remove features, products, content, or portions of the Services.Ant's Sketchbook may modify, suspend, discontinue, add, or remove features, products, content, or portions of the Services.
We do not guarantee that any particular artwork, portfolio item, product, feature, or Service will remain continuously available.
Restricted portfolio materials may be added, removed, or modified without creating an obligation to preserve access to any particular piece.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis except for warranties expressly provided by Ant's Sketchbook or warranties that cannot lawfully be excluded.
Ant's Sketchbook does not warrant that the website will always be uninterrupted, error-free, completely secure, or free from every harmful component.
Nothing in this section excludes warranties or consumer protections that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Ant's Sketchbook and its owner, agents, contractors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services, except where such limitation is prohibited by law.
To the fullest extent permitted by applicable law, Ant's Sketchbook's aggregate liability arising from a particular purchased product or transaction will not exceed the amount actually paid to Ant's Sketchbook for the product or transaction giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Ant's Sketchbook and its owner, representatives, contractors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, infringement of third-party rights, unauthorized exploitation of protected artwork, or material violation of these Terms.
This provision does not require indemnification to the extent a claim results from conduct for which Ant's Sketchbook is legally responsible and liability cannot lawfully be shifted.
Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or severed to the minimum extent necessary.
The remaining provisions will continue in effect to the extent permitted by law.
No Waiver
Failure by Ant's Sketchbook to immediately enforce a provision of these Terms does not constitute a waiver of that provision or of the right to enforce it later.
A waiver concerning one event does not constitute a continuing waiver unless expressly stated.
Entire Agreement
These Terms, together with the Privacy Policy, Returns & Refunds Policy, Shipping Policy, applicable product terms, and any other policies or terms expressly incorporated into them, constitute the agreement governing ordinary use of the Services.
Separate written agreements concerning commissions, licensing, employment, contract work, or other professional engagements may supplement or supersede portions of these Terms as expressly provided in those agreements.
Governing Law
These Terms and disputes arising from the Services will be governed by the laws applicable to Ant's Sketchbook's principal place of business, without giving effect to conflict-of-law principles, except to the extent applicable consumer-protection or other law requires otherwise.
Any mandatory rights or remedies available to a consumer under applicable law remain unaffected.
Changes to These Terms
Ant's Sketchbook may update these Terms from time to time to reflect changes in the Services, products, business practices, legal requirements, security practices, or other operational needs.
The revised Terms will be posted through the Services and the "Last updated" date will be updated.
Unless applicable law requires otherwise, the Terms in effect when a transaction occurs will generally govern that transaction, while continued use of the Services after revised Terms take effect will be subject to the revised Terms.
